The short answer

Not always. Decision 1112/2566 illustrates that recognising electronic communications as written evidence is separate from proving a loan. The chats in that case did not sufficiently establish that THB 7.8 million had been lent.

The case facts

The claimant sought THB 7,800,000, relying in part on a cheque deposit and LINE messages. The nature of the payment, a loan or an investment-related transaction, was disputed, making the context of the communications central.

Format and evidential meaning are different questions

The Court considered Electronic Transactions Act sections 8 and 9 with Civil and Commercial Code section 653 paragraph one. The messages did not sufficiently establish the alleged loan.

The lesson is not that LINE is unusable. The communication must establish the relevant obligation in its full context.

A transfer record does not explain itself

A transfer could be a purchase price, investment, repayment or loan. Retain records explaining why it was made. A short reply such as an undertaking to sort something out must be read against the actual discussion, not isolated to support a preferred interpretation.

Prepare the record before a claim

Describe the actual agreement and reconcile the outstanding balance. Do not edit or manufacture old conversations to fill gaps; have the available evidence assessed.

  • Pre-transfer agreement, purpose and repayment terms
  • Payment evidence and party identities
  • Complete communications before and after demands
  • Repayment history and documents mentioned in the chats

Use the decision within its limits

The decision addressed a particular evidential record. It does not mean all transfers are irrecoverable and is not an office case result. Trade debts or other investment disputes may involve different rights and documents.
